Accepting these terms
These terms are an agreement between you and Invictus (“Invictus”, “we”, “us”) covering this website, the Invictus liquidity terminal and related services (the “Service”). By connecting a wallet or using the Service, you agree to them and to our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You may use the Service only if:
- you are at least 18 and able to enter a binding contract;
- you are not located in, or a resident of, a country or region subject to comprehensive sanctions, and you are not on any sanctions list; and
- your use of the Service is lawful where you live.
We may restrict access from certain locations at any time.
The Service
Invictus is software that helps you discover liquidity pools, analyse them, and deploy and manage liquidity positions on third-party protocols across supported networks. Invictus is not an exchange, broker, bank or investment adviser. It does not operate the protocols you use, and it does not control the blockchains they run on.
Data shown in the Service, including prices, fee APR, volume and TVL, comes from public blockchains and third-party sources. It may be delayed, incomplete or wrong, and past performance does not predict future returns.
Your wallet and Invictus wallets
You connect a wallet that you control. You alone are responsible for it, including its keys, seed phrase and the devices it lives on. We cannot recover access to it for you.
To deploy liquidity, Invictus creates dedicated wallets linked to your connected wallet. By using them you authorise Invictus to create transactions from those wallets to carry out the actions you request, such as depositing, rebalancing, claiming fees and withdrawing. Funds in Invictus wallets are attributed to you and can be withdrawn to your connected wallet, subject to network conditions, protocol limits, applicable law and the security checks described in these terms.
Check every transaction before you sign it. Confirmed blockchain transactions are final and cannot be reversed by Invictus or anyone else.
Risks you accept
Providing liquidity is risky, and you could lose some or all of the assets you deploy. Risks include:
- Market risk: price moves, volatility and impermanent loss.
- Range risk: concentrated positions stop earning fees when price leaves your range.
- Smart contract risk: bugs, exploits or upgrades in protocols, tokens or Invictus software.
- Network risk: congestion, outages, reorganisations, failed transactions and changing gas fees.
- Asset risk: stablecoins losing their peg, token freezes, and illiquid or malicious tokens.
- Regulatory risk: laws that change and may affect your ability to use the Service.
You are responsible for deciding whether any action suits you.
Fees
Network gas fees and protocol fees are paid to third parties and are set by them, not by us. If Invictus charges a fee for a feature, we will show it before you confirm. You are responsible for any taxes on your activity.
Acceptable use
You agree not to:
- break any law, including sanctions, anti-money-laundering and market manipulation laws;
- use the Service with funds or assets obtained illegally;
- attack, probe, overload or disrupt the Service, or get around its security or access limits;
- copy, scrape or reverse engineer the Service beyond what the law allows; or
- impersonate Invictus or use our brand in a misleading way.
Third-party services
The Service connects to blockchains, protocols, wallets, data providers and other services we do not control. Your use of them is governed by their own terms. We are not responsible for their availability, security or actions, or for any loss they cause.
Intellectual property
The Service and its software, design and content belong to Invictus or its licensors. We give you a limited, revocable, non-transferable right to use the Service for its intended purpose. You may use the assets in our Brand Kit to refer to Invictus, following its guidelines. Third-party names and logos belong to their owners.
No advice
Nothing in the Service is financial, investment, legal or tax advice, or a recommendation to buy, sell or hold any asset or to use any protocol. Analytics, scores and strategies are tools to help you decide for yourself.
Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted, error-free or secure, or that any data is accurate.
Limitation of liability
To the fullest extent the law allows, Invictus and its team are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or digital assets, arising from your use of the Service. Our total liability for any claim is limited to the greater of the fees you paid us in the 12 months before the claim and USD 100. Some jurisdictions do not allow these limits, so they may not all apply to you.
Indemnity
You agree to defend and indemnify Invictus against claims, losses and costs, including reasonable legal fees, arising from your breach of these terms, your misuse of the Service or your violation of any law or third-party right.
Suspension and termination
We may suspend or end your access to the Service if you breach these terms, if the law requires it, or to protect users or the Service. Where we can, we will give you notice and the chance to withdraw assets from Invictus wallets. You may stop using the Service at any time.
Changes to these terms
We may update these terms. We will change the date at the top and, for material changes, give notice before they take effect. If you keep using the Service after that, you accept the updated terms.
Governing law and disputes
These terms are governed by the laws of [jurisdiction]. Disputes will be resolved in the courts of that jurisdiction, unless the law where you live gives you the right to bring them elsewhere. Before starting any formal proceedings, please contact us so we can try to resolve the issue informally.
Reach the team on Discord and we will reply as soon as we can.
